These Terms govern and apply to your access and use of Mikado Education Foundation (the company hereafter referred as “Mikado Education Foundation”) service “Mikadoeduconnect”. Mikadoeduconnect is available via www.Mikadoeducation foundation.com website and Android store apps (collectively, the “Mikadoeduconnect” or “Service(s)”). By accessing or using our Service, you acknowledge & agree to be bound all of the terms and conditions described in these Terms. If you do not agree to all of these terms and conditions, do not use our Service.
These Terms of Service apply to all users of the Mikadoeduconnect. Information provided by our users through the Mikadoeduconnect may contain links to third party websites that are not owned or controlled by Mikado Education Foundation. Mikado Education Foundation has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, Mikado Education Foundation will not and cannot censor or edit the content of any third-party site. By using the Service, you expressly acknowledge and agree that Mikado Education Foundation shall not be responsible for any damages, claims or other liability arising from or related to your use of any third-party website.
Our App is intended for use by students of Mikado World School, including minors under the age of 18. We collect personal data only to the extent necessary for educational purposes, and with the consent of parents or guardians where required by law. If you are a parent or guardian and you believe that your child has provided us with personal data without your consent, please contact us, and we will take steps to remove that information from our servers. Mikadoeduconnect allows you to access student specific school information through our mobile and web-based apps and our site (each an “App”). As long as you comply with these Terms, you have the right to download and install a copy of the App to your mobile device, and to access and use the Mikadoeduconnect, for your own personal use.
(i) You are eighteen (18) years of age or older and have full power and authority to enter into this Terms of Service.
(ii) You will not provide any false personal information on or through the Service, or create an account for anyone other than yourself without such other’s permission.
(iii) You can login up to two (2) personal devices (here personal means your smartphone device and devices of your immediate family members including your parents) using the same login ID. You will not share your password with anyone outside the immediate family, let anyone else access your account, or do anything else that might jeopardize the security of your account.
(iv) You will not use an email ID and/or phone number of another person with the intent of impersonating that person.
(v) Your use of the Service as permitted is solely for your personal use, and you are not permitted to resell or charge others for use of or access to the Service, or in any other manner inconsistent with these Terms of Service.
(vi) You will not duplicate, transfer, give access to, copy or distribute any part of the Service in any medium without Mikado Education Foundation's prior written authorization.
(vii) You will not attempt to reverse engineer, alter or modify any part of the Service and
(viii) You will otherwise comply with the terms and conditions of these Terms of Service and Privacy Policy.
The design of the Mikadoeduconnect along with its created text, voice, scripts, graphics, interactive features and the like, except Submissions (as defined below), and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to Mikado Education Foundation, subject to copyright and other intellectual property rights under India and foreign laws and international conventions. The Service is provided to you AS IS for your information and personal use only. Mikado Education Foundation reserves all rights not expressly granted in and to the Service. You agree to not engage in the use, copying, or distribution of any of the Service other than expressly permitted herein, including any use, copying, or distribution of voice and text messages, notifications and status Submissions of third parties obtained through the Service for any commercial purposes.
(i) You own or have the necessary licenses, rights, consents, and permissions to use and authorize Mikadoeduconnect to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all Contents to enable inclusion and use of the Contents in the manner contemplated by the Service and these Terms of Service; and
(ii) you have the written consent, release, and/or permission of each and every identifiable individual person in the Contents to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the Contents in the manner contemplated by the Service and these Terms of Service.
To be clear: you retain all of your ownership rights in your Contents, but you have to have the rights in the first place. However, by submitting the Contents to Mikadoeduconnect, you hereby grant Mikadoeduconnect a worldwide, non-exclusive, royalty-free, sub licenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Status Submissions in connection with the Mikadoeduconnect and Mikado Education Foundation's other (and its successor's) business, including without limitation for promoting and redistributing part or all of the Mikadoeduconnect (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each subscriber to your message on the Mikadoeduconnect a non-exclusive license to access your Contents through the Service.
(i) submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant Mikado Education Foundation all of the license rights granted herein;
(ii) publish falsehoods or misrepresentations that could damage Mikado Education Foundation or any third party;
(iii) submit material that is unlawful, obscene, defamatory, libelous, threatening, harassing, hateful, racially, religiously or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate;
(iv) post advertisements or solicitations of business without Mikado Education Foundation’s explicit written permission;
(v) impersonate another person;
(vi) send or store material containing software viruses, worms, Trojan horses or other harmful computer code, files, scripts, agents or programs;
(vii) interfere with or disrupt the integrity or performance of the Service or the data contained therein; or
(viii) attempt to gain unauthorized access to the Service or its related systems or networks.
(i) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
(ii) Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works;
(iii) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material, including the mobile phone number and/or email ID of the Mikadoeduconnect user allegedly infringing the copyrighted work;
(iv) Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and an electronic mail address at which the complaining party may be contacted;
(v) A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
(vi) A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Such takedown notices may be emailed to contact at Mikado Education Foundation.com. Mikado Education Foundation reserves the right to remove any content without prior notice. Mikado Education Foundation may also terminate a user's access to the Service, if they are determined to be a repeat infringer, or for any or no reason, including being annoying. A repeat infringer is a User who has been notified of infringing activity more than once and/or has had a content removed from the Service more than twice. An annoying person is anyone who is (capriciously or not) determined to be annoying by authorized Mikado Education Foundation employees, agents, subagents, superagents or superheros. Mikado Education Foundation also reserves the right to decide whether content is appropriate and complies with these Terms of Service for violations other than copyright infringement and violations of intellectual property law, such as, but not limited to excessive length or limited interest. Mikado Education Foundation may remove such Contents and/or terminate a User's access for uploading such material in violation of these Terms of Service at any time, without prior notice and at its sole discretion.
YOU AGREE THAT YOUR USE OF THE MIKADOEDUCONNECT SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, MIKADO EDUCATION FOUNDATION, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF. MIKADO EDUCATION FOUNDATION MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS SERVICE'S CONTENT AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE THROUGH THE ACTIONS OF ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONSIN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE MIKADOEDUCONNECT. MIKADO EDUCATION FOUNDATION DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE MIKADOEDUCONNECT OR ANY HYPERLINKED WEBSITE OR FEATURED IN ANY USER COMMUNICATION OR OTHER ADVERTISING, AND MIKADO EDUCATION FOUNDATION WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE. AND AGAIN, USE THIS JUST FOR FUN.
IN NO EVENT SHALL MIKADO EDUCATION FOUNDATION, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVERS, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY, (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE MIKADO EDUCATION FOUNDATION CLIENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND/OR (VI) THE DISCLOSURE OF INFORMATION PURSUANT TO THESE TERMS OF SERVICE OR PRIVACY POLICY. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. YOU SPECIFICALLY ACKNOWLEDGE THAT MIKADO EDUCATION FOUNDATION SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU. The Service is controlled and offered by Mikado Education Foundation from its facilities in the India. Mikado Education Foundation makes no representations that the Mikadoeduconnect is appropriate or available for use in other locations. Those who access or use the Mikadoeduconnect from other jurisdictions do so at their own volition and are responsible for compliance with local law.
You agree to defend, indemnify and hold harmless Mikado Education Foundation, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Mikadoeduconnect; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your contents caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the Mikadoeduconnect.
You affirm that you are either more than 18 years of age, or not a minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service. In any case, you affirm that you are at least 18 years old as the Mikadoeduconnect is not intended for children under 18. If you are under 18 years of age, you are not permitted to use the Mikadoeduconnect. You further represent and warrant that you are not located in a country that is subject to a Indian Government embargo, or that has been designated by the Indian Government as a” terrorist-supporting” country, and that you are not listed on any Indian list of prohibited or restricted parties.
These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Mikado Education Foundation without restriction.
(i) The Mikadoeduconnect shall be deemed solely based in Udaipur, India; (ii) the Mikadoeduconnect shall be deemed a passive server that does not give rise to personal jurisdiction over Mikado Education Foundation, either specific or general, in jurisdictions other than Udaipur, India; and (iii) that you agree to subject to the jurisdiction of Udaipur,India in the event of any legal dispute. These Terms of Service shall be governed by the internal substantive laws of the Republic of India, without respect to its conflict of laws principles. Any claim or dispute between you and Mikado Education Foundation that arises in whole or in part from the Mikadoeduconnect shall be decided exclusively by a court of competent jurisdiction located in Udaipur, India.
These Terms of Service, together with the Privacy Policy at http://www.Mikadoeduconnect.me/Privacy and any other legal notices published by Mikado Education Foundation, including, but not limited to an end user license agreement, shall constitute the entire agreement between you and Mikado Education Foundation concerning the Mikadoeduconnect. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect. No waiver of any term of this these Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and Mikado Education Foundation's failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision. Mikado Education Foundation reserves the right to amend or modify these Terms of Service at any time, and it is your responsibility to review these Terms of Service for any changes. If you do not agree to the revised Terms, your only recourse is to discontinue the use of the Mikadoeduconnect. Your continued use of the Mikadoeduconnect following any amendment of these Terms of Service will signify your assent to and acceptance of its revised terms. YOU AND MIKADO EDUCATION FOUNDATION AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE Mikadoeduconnect MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
Mikadoeduconnect®, Daycarez® & Zoment™ (henceforth collectively referred as Mikadoeduconnect®) are the products of Mikado Education Foundation Services Private Limited. Mikadoeduconnect® provides a combined parent engagement & school management software. This privacy policy applies to all our customers namely k12 schools, pre-schools, kindergarten, daycares, colleges, tuition classes, universities & other educational institutes. Our Privacy Policy describes how Mikadoeduconnect® collects, uses and discloses information, and what choices you have with respect to the information.
We at Mikadoeduconnect® are committed towards your privacy regarding any information that we collect, while you use our platform components called the Services.
This Privacy Policy applies when you use Mikadoeduconnect® Services. Mikadoeduconnect® platform consists of around 40+ modules and Mikadoeduconnect® mobile app, Mikadoeduconnect® web app and Mikadoeduconnect® Website are collectively called “Services”. Data Controller and Data Processor
● Customer Data – Personal data that forms part of data that is provided by our customers and their end-users for processing. We are the Processor of this data.
● Other Data – Personal data about our visitors and other individuals that is collected and processed directly for sales reach out. We are the Controller of this data.
Mikadoeduconnect® uses the Customer’s Personal Data for the purpose of providing relevant Services subscribed by the Customer as per the contract and not for any other marketing purposes.
● Customer(s) – Educational institutes are the primary customer of the Mikadoeduconnect® platform.
● End-User(s) : Customer may extend Mikadoeduconnect® services to its end user(s) such as but not limited to teachers, parents, guardians, students, staff members etc.
● Customer Data : Customer provided data for processing as part of usage of our Mikadoeduconnect® platform.
Customer Data is processed by us when we obtain the customer’s or their end-user’s information. “You”, “Your”, “Customer(s)” or “End-user(s)” shall be used interchangeably to mean the same – Mikadoeduconnect® customer. Following is the end-user data we collect when Mikadoeduconnect® is setup for a customer. Mandatory Information captured in Mikadoeduconnect®: This information is critical and must have for the creation of institution, user accounts and smooth operations of Mikadoeduconnect® mobile & web app.

Educational institute may want to capture more details about teachers, parents & children for their day to day operations using dynamic fields. Some of these dynamic fields could be Blood group, Country specific unique identifier, Passport & Visa information, Enrollment number, Scholar number, PEN no. , height, weight, performance data for students, Parent income etc. We collect data when the customer uses our platform or provides it directly to us.
● Log Data – Our servers automatically collect information when you (customer or end user) access or use our applications and services. This data is recorded in log files. Examples of such data include IP Addresses, mobile device name & OS & web browser name & versions.
● Demo Data – We also collect the information that you provide to us as part of requesting a demo of our products.
● Contact Us Data – When you enquire about our products and services, we collect and store this data to communicate with you and respond to your enquiry.
Cookies We do not collect data through cookies. How We Use Your Data? How we use your personal data depends on which Services you use and how you use those Services. Customer Data will be used by Mikadoeduconnect® in accordance with Customer’s instructions, including any applicable terms in the Customer Agreement and as required by applicable law. Mikadoeduconnect® is a processor of Customer Data and Customer is the controller. Lawful Basis For Processing We have lawful bases to process your personal data. Mikadoeduconnect® has a performance contract with you (the customer) and as part of that contract Mikadoeduconnect® shall be lawfully processing your personal data. In some cases, we may also have a legal obligation to collect personal information from you. How We Use Customer Data? We use your data to authenticate and authorize access to our services.
We only process Customer Data on behalf of our customers and in accordance with their instructions provided in the applicable Services agreement with us. We use your data to provide you a better experience and thus support you with our service. In each case, Mikadoeduconnect® collects such information only when it is extremely necessary or appropriate to fulfil the purpose of the interaction with our services. To provide Services. We process Customer Data as a Data Processor to provide services to our customers through the Mikadoeduconnect® platform. ● Customer Support: If you send us a request (for example via a support email, phone call or via one of our feedback mechanisms), we respond to your request and assist you in resolving the issue faster. ● Other purposes: For any other purpose as provided for in the Services Agreement between Mikadoeduconnect® and the customer, or as otherwise authorized by the customer. In accordance with or as may be required by law.
How Do We Use Other Data? Mikadoeduconnect® may send you service related messages and notifications. Mikadoeduconnect® may share your (customer and end user) basic information with third party providers as described in the “Your Information Shared With Others” section below. Mikadoeduconnect® may also relay customer generated & triggered information as part of its normal operations.
Users under 18 years of age The Mikadoeduconnect® Services do not directly collect personal information from end users under the age of 18. Mikadoeduconnect® Customers, i.e educational institutes, collect student information as part of their internal processes and management and some of them may be under the age of 18. We sign explicit contracts with our customers confirming that they have each parent’s explicit consent to capture their children information before adding those children to Mikadoeduconnect® platform. If you are under the age of 18, you are not permitted to sign-up or use the Services or to disclose Personal Information directly to Mikadoeduconnect®. If we learn we have collected or received Personal Information from a child under 18 without parent’s explicit consent, we will delete that information.
Data Retention Policy We will retain your personal information as long as it is needed to fulfil the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. ● Customer Data – We retain your information as long as you have an active Services account. We may also retain your personal information for an extended period under applicable statutory laws. ● Mikadoeduconnect® will retain Customer Data in accordance with a Customer’s instructions, including any applicable terms in the Customer Agreement and as required by applicable law.
When you decide to stop using our services, we will either delete or return all data related to school information, parent & child information, teacher & staff information, fees and payment details etc , as per your instructions. Here it is clarified that any transactional data generated on the platform such as but not limited notices, messages sent or received, images, videos shared and/or received etc that may not be feasible to return in their original form, shall be deleted from the Mikadoeduconnect® platform. Refund Policy ● Transaction fee charges would not be refunded / reversed under any circumstances for any refund / reversal / chargeback and any other reasons. ● Transaction fees charged would be borne by cardholder for any payment.
